This privacy policy describes how Eva Pet, Inc. and Eva Pet Canada, Inc. (collectively, “Eva”, “we”, “us” or “our”) collect, use, disclose, and protect personal information. It also describes the rights and choices you have and how to reach us. Our privacy practices are subject to the laws of the places in which we operate, and this policy includes region-specific terms that apply only to residents of those regions.
1. What this policy covers
This policy covers Eva’s customer-facing operations in the United States and Canada. It applies to personal information Eva obtains through evapup.com and its subdomains (including shop.evapup.com and account.evapup.com), any Eva website, application, or tool where this policy is referenced, our stores, our events, and your communications with us (collectively, the “Sites”). Products are currently sold and shipped only within the United States.
We may provide additional or just-in-time notices for particular activities or programs.
Our Sites link to websites operated by third parties, including retailers whose products appear on our Sites. We do not control those websites and encourage you to review their privacy practices.
2. Personal information we collect
“Personal information” means information that identifies, relates to, describes, or can reasonably be associated with you. Depending on how you interact with us, we collect the following categories.
Basic identifying information. Your name, postal address, email address, phone number, date of birth, state or province of residence, account name, username, and similar identifiers.
Device information and unique identifiers. Device identifiers, IP address, browser type, cookies, pixel tags, and similar identifiers.
Internet or other network activity. Your browsing and search activity on our Sites, your interactions with our emails and advertisements, and session replay recordings of your interactions with our website, with text inputs and account pages masked.
Geolocation data. Approximate location derived from your IP address, or precise location if you choose to provide it.
Payment information. Payment card details, processed by our payment providers.
Commercial information. Products or services you have purchased, returned, or considered; products you add to your Eva Puppy List from any website, including the web address you submit; your interactions with product offers from other retailers shown on our Sites; and rewards activity in the Pack Privé program.
Pet profile information. Information you provide about your dog, including name, breed, size, sex, date of birth or arrival date, photo, weight, diet, food and treat brands, and care preferences.
Pet health information. Information you choose to provide about your dog’s health, such as allergies, medications, veterinary visits, and conditions. We store this in your dog’s profile to provide recommendations and care services. We do not collect health or medical information about you as a person.
Demographic data. Age and household information you provide.
User content. Your communications with us, notes you add to your Eva Puppy List, answers to profile questions, photos you upload of your dog, and product ratings and reviews you submit. Reviews are the only user content that is public; see Section 6.
Ask Eva conversations. Questions you ask our Ask Eva assistant and the answers it provides, retained for 90 days. Conversations on accounts held by people under 18 are not stored beyond the session.
Audio information. Recordings of customer service calls, where we record them for quality assurance, with notice at the time.
Inferences. Inferences drawn from the information above, such as which products may interest you based on your dog’s profile and life stage.
Job applicant information. Covered by our separate Applicant Privacy Policy.
Sensitive personal information. We collect sensitive personal information, as defined by applicable law, only for purposes allowed by law or with your consent, and we do not use it to infer characteristics about you.
3. How we collect personal information
Directly from you. When you create an account, build an Eva Puppy List or dog profile, make a purchase, join Pack Privé, book an appointment, sign up for emails, respond to a survey, write a product review, contact us, or interact with us in a store or at an event.
When you add products from other websites. When you add a product to your Eva Puppy List by submitting a web address, we retrieve publicly available product information from that page and from our affiliate and price-comparison partners to create the list entry.
Through online tracking technologies. When you visit our Sites or open our emails, we and our service providers automatically collect information using cookies, pixels, and similar technologies, as described in Section 4.
Through in-store technologies. We record customer service calls, keep transcripts of chats (including chats with Ask Eva), and use closed-circuit cameras in our stores for safety, security, and loss prevention.
From Shopify. Our online store runs on Shopify. When you place an order, Shopify provides us with your order and contact information.
From our business partners. From partners that participate in Pack Privé, based on your direction to share the information.
From social media platforms. When you interact with us on social media or use social media features on our Sites, we receive the information you or the platform disclose to us.
From other sources. Data analytics providers, marketing providers, fraud prevention providers, service providers acting on our behalf, and publicly available sources. We also create information based on our analysis of the information we have collected.
4. Cookies and similar technologies
We and our service providers use cookies, pixels, web beacons, session replay, and similar technologies (“online tracking technologies”) when you interact with our Sites and emails.
Categories. We group these technologies into four categories and let you choose which to allow. Necessary technologies keep the Sites secure and functioning and cannot be turned off. Analytics technologies, including Google Analytics, help us understand how the Sites are used. Session replay technology, provided by Microsoft Clarity, records how visitors interact with pages so we can find usability problems; text you type and your account pages are masked. Marketing technologies help us show you relevant offers and measure our advertising.
Your choices. When you first visit our Sites, a banner lets you accept all categories, reject all non-necessary categories, or choose by category. You can change your choices at any time through the “Cookie Preferences” link at the bottom of every page.
Global Privacy Control. We honor the Global Privacy Control browser signal as a request to opt out of the sale or sharing of personal information and of targeted advertising. When we receive the signal, we treat the marketing and session replay categories as declined for that browser and, if you are signed in, for your account.
Sale or sharing. To the extent our use of marketing technologies is considered a “sale” or “sharing” under U.S. state law, you can opt out through the “Your Privacy Choices” link at the bottom of every page, or by sending the Global Privacy Control signal. For Google Analytics you may also install the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout.
Canada. Residents of Canada can control online tracking technologies through the same banner and the “Cookie Preferences” link.
5. How we use personal information
Providing products and services. To create and maintain your account, your dog’s profile, and your Eva Puppy List; to fulfill orders and process payments; to send receipts, order updates, and account notifications; to notify you of price changes and availability on items in your list; to book and deliver grooming and other services; to invite you to review products you have purchased and to display your reviews; and to answer questions through Ask Eva, an AI assistant that draws on our published guides and product catalog.
Communicating with you. To respond to your requests and provide customer service.
Administering programs. To operate Pack Privé and our welcome kit program, including enrolling you, tracking points and tier, awarding points for activities such as completing your dog’s profile, delivering benefits, and making donations you choose to charities on your behalf.
Marketing. To send marketing communications by email, text message, or mail where you have agreed to receive them; to show you advertisements for products and services on social media and other websites; and to administer sweepstakes, contests, and promotions. We do not send marketing communications to accounts we know belong to people under 18.
Analytics and personalization. To understand how you use our Sites and communications; to improve our Sites, products, and services; to personalize your experience and recommendations based on your dog’s profile; and to identify products that many customers add to their lists so we can decide what to carry. This last use relies on list activity in aggregate.
Artificial intelligence. We use artificial intelligence and machine learning to power Ask Eva, to extract product information from web addresses you submit, to match products across retailers, to generate embeddings for search, and to support analytics. AI outputs may be inaccurate or incomplete and are not veterinary or medical advice.
Security and fraud prevention. To detect, investigate, and prevent fraudulent, deceptive, malicious, or illegal activity and to protect the rights, property, and safety of Eva, our customers, and others.
Legal obligations. To comply with legal and regulatory obligations and to establish, exercise, or defend legal claims.
Core business functions. Record keeping, loss prevention, collecting amounts owed, and maintaining and repairing the Sites.
Job applicants. To make recruitment decisions.
6. How we disclose personal information
Corporate affiliates. Our parent, subsidiaries, and affiliates, including Eva Pet Canada, Inc. and Eva Pet USA, Inc., which process personal information on our behalf as service providers or with your consent.
Service providers. Companies that perform services for us, including Shopify (online store and payments), Klaviyo (email and marketing), Resend (transactional email), Google (analytics, tag management, and sign-in), Microsoft (session replay and cloud hosting), Cloudflare (network security and delivery), Google and Anthropic (AI models), TurnTo, a service of Emplifi (collection, moderation, and display of product ratings and reviews), LoyaltyLion (operation of the Pack Privé program), Cloudflare (network security, delivery, and video hosting), and providers that fulfill orders, deliver packages, prevent fraud, conduct surveys, and provide customer service.
Product reviews. If you write a review, it is displayed publicly on our Sites with the display name you choose, your review text, rating, and any photo you attach, and the date. Your email address and full name are not displayed. Through TurnTo’s syndication network, your review may also be displayed on the website of the brand whose product you reviewed and on other retailers’ websites that sell the same product, with the same display information. To have a review removed, email [email protected]; removal from our Sites is prompt, and we forward removal requests to TurnTo for syndicated copies. Reviews written on brand or retailer websites and syndicated to our Sites are governed by the privacy policy of the site where they were written.
Affiliate networks and retailers. When you click a link on our Sites to another retailer, that retailer and our affiliate networks (including Sovrn Commerce, Amazon Associates, and the affiliate programs of Chewy, Petco, and other merchants) receive information that the click came from Eva and which page it came from. Eva may earn a commission on a resulting purchase. We do not send your account information to affiliate networks or retailers.
Business partners. Partners with whom we jointly offer a product, service, or promotion, based on your direction to share the information. Their use of your information is governed by their own privacy policies.
Social media platforms. When you use social media features on our Sites, information may be exchanged with the platform. Their use of your information is governed by their own policies.
Legal process. In response to subpoenas, court orders, government requests, or as required by law; to enforce our terms; to protect the safety of our visitors; and to detect and prevent fraud.
Transfer of control. To a company that acquires some or all of Eva’s assets or stock, and to prospective purchasers evaluating such a transaction.
Other instances. With your consent, in circumstances not described above.
7. How we protect personal information
Personal information is maintained on our servers or those of our service providers and is accessible only by authorized employees, representatives, and agents as necessary for the purposes described here. We maintain reasonable physical, electronic, and procedural safeguards. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
Our Sites let you stay signed in so you do not have to enter your password each time. If you choose to stay signed in, anyone with access to your device may be able to access your account. Protect your device and notify us promptly if you suspect unauthorized use of your account.
8. Your rights and choices
Rights vary by state, province, and country. We do not discriminate against anyone for exercising their rights.
Opting out of sale, sharing, and targeted advertising. Use the “Your Privacy Choices” link at the bottom of every page, or send the Global Privacy Control signal. If you are not signed in, your opt-out applies to your browser. If you are signed in, it applies to your account as well.
Nevada. We do not sell personal information as defined under Nevada law. To request confirmation, email [email protected] with “Nevada Opt-Out of Sale” in the subject line.
Sensitive personal information. We collect sensitive personal information only for purposes allowed by law or with your consent and do not use it to infer characteristics about you. Because our uses fall within the purposes allowed by law, we do not offer a separate right to limit its use.
Access, correction, download, and deletion. Depending on where you live, you may have the right to know what personal information we hold about you, to correct it, to receive a copy, and to have it deleted. Residents of Canada, including Quebec, have the right to access and rectify their personal information and to withdraw consent.
If you have an Eva account, you can exercise these rights yourself: sign in, go to Account, and use Download my data or Delete my account. Deleting your account removes your personal information and your dog’s profile from our systems, sends a data erasure request to Shopify for your order history, unsubscribes you from our marketing, and removes your reviews from our Sites and requests their removal from TurnTo. List activity is retained only in anonymized, aggregated form that cannot be linked to you.
If you do not have an account, or prefer to submit a request another way, use the form at evapup.com/privacy-request or email [email protected]. We verify identity by sending a confirmation link to the email address on file. You may designate an authorized agent to submit a request on your behalf if you give the agent written permission and verify your own identity with us.
Responding to requests. We respond within the time permitted by applicable law. We may charge a reasonable fee for repeated requests within a twelve-month period where the law permits. You may appeal a decision by replying to our response or emailing [email protected]; Canadian residents may also complain to a privacy commissioner.
Retention. We keep personal information for as long as needed for the purposes in this policy unless a longer period is required or permitted by law. Ask Eva conversations are kept for 90 days and can be deleted from your Account page at any time. Information may be retained longer to comply with legal obligations, resolve disputes, enforce agreements, or prevent fraud.
Marketing emails. Click “unsubscribe” in any marketing email, or sign in and change your preferences under Account, Notifications.
Text messages. If you have opted in to text messages, reply STOP to any message to opt out.
9. Transfers to other countries
Eva Pet, Inc. is located in the United States. Eva Pet Canada, Inc. is located in Canada and uses service providers and affiliates that may be located outside Canada, including in the United States. If you submit personal information to us, it may be processed in a country whose privacy laws differ from those where you live. By submitting personal information you agree to its transfer, storage, and processing in the United States and other countries.
10. Children’s privacy
Our Sites are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Our Sites are also not directed to residents of Colorado, Connecticut, Delaware, Maryland, or New Jersey who are under 18. We collect date of birth and state of residence when you create an account to apply these rules. If we learn that we have collected personal information in violation of them, we delete it. Accounts held by people under 18 receive no marketing communications, no targeted advertising, and no session replay.

12. Changes to this policy
We may revise this policy from time to time and will post the date it was last updated at the top. We will provide additional notice of changes that materially affect your privacy rights.
13. Additional information for California residents
Shine the Light. California residents may request that we not disclose personal information to third parties for their direct marketing purposes. Email [email protected].
Eraser Button. If you are a California resident under 18 and a registered user, you can request removal of content you have posted by emailing [email protected]. Removal may not be complete if the content has been copied elsewhere.
Categories collected and purposes. See Sections 2, 3, and 5.
Categories disclosed and recipients. For business or commercial purposes we disclose: basic identifying information, device information, internet activity, geolocation data, and commercial information to service providers and to advertising, analytics, and social media partners; payment information to payment processors; pet profile and pet health information to service providers that help us provide recommendations and care services; user content to service providers that operate our Sites, and product reviews to TurnTo and, through syndication, to the brand reviewed and other retailers; audio information to customer service and fraud prevention providers; and inferences to service providers that support marketing and personalization. We may also disclose any category under legal process or in a transfer of control.

14. Notice of financial incentive and loyalty programs
We offer the Pack Privé loyalty program, which provides rewards and exclusive offers, and a welcome kit program. We may also run sweepstakes, contests, and promotions (together, the “Programs”). When you join a Program we typically ask for your name and contact information.
Pack Privé. Membership is free with an Eva account. Members earn one point per dollar spent at the Eva store and additional points for activities that involve providing personal information or pet profile information, including creating an account (25 points), completing your dog’s profile (200 points), entering your dog’s breed (25 points) and birthday (25 points), your own birthday (25 points), following Eva on social media (50 points each), completing a survey or poll (200 or 25 points), writing a review (50 points, or 100 with a photo), and referring a friend (50 points). Points are redeemable at 500 points for $10 off a purchase or for charitable donations at the rates on the Pack Privé page. Because points are offered in exchange for information, the program is a financial incentive under California law. The value of your information to us is reasonably related to the value of the points and tier benefits you receive, less our cost of providing them. You may join or leave at any time; leaving forfeits unredeemed points. Details are in the Terms of Service, Section 10.
Welcome kit. Customers who place one order of $40 or more on shop.evapup.com may receive a welcome kit with a stated retail value of $100 for a shipping charge of $8.95 plus tax, limited to one kit per household per year and to addresses in the United States. Contents vary and Eva may substitute items of equal or greater value. You may decline the kit without affecting your order.
Because the Programs involve collecting personal information in exchange for benefits, they may be considered a “financial incentive” under California law or a “bona fide loyalty program” under Colorado law. The value of your personal information to us is related to the value of the benefits you receive, less our cost of providing them.
